1. Scope of Application

These General Terms and Conditions (GTC) apply to all deliveries from AK Webdesign (Other) to the consumer.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities.

3. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer but rather an invitation to place an order.

By clicking the “Buy/Place Paid Order” button, you submit a binding order for the goods listed on the order page. Your purchase contract is formed when we accept your order by sending an order confirmation via email immediately after receiving your order. Please note that you are required to provide a valid, accessible email address during the ordering process.

4. Prices & Packaging

The prices valid at the time of the order are those listed in the offer. These are final prices and include the statutory German VAT. For items on special offer at the time of purchase or for which a voucher has been redeemed, the reduced price is included in the final order summary.

The packaging becomes the property of the customer upon delivery.

5. Payment

We generally offer the following payment methods:

  • PayPal

  • Sofort by Klarna

We reserve the right to exclude certain payment methods for specific orders and refer customers to our standard payment options.

Advance Payment

If you choose advance payment, we will provide our bank details in a separate email and deliver the goods after payment is received.

Credit Card

You pay directly during the checkout process by entering your credit card details. Your card will be charged the actual invoice amount (after deducting any discounts or vouchers) upon shipment. For custom-made or personalized goods, your card will be charged immediately.

PayPal

You pay directly via your PayPal account. After submitting your order, you will be redirected to PayPal to authorize the payment. Once we receive confirmation, your order will be shipped. Your PayPal account will be charged immediately after authorization.

Sofort by Klarna

In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer Klarna PayLater as a payment method. Payment is made to Klarna. Further details can be found in Klarna’s terms and conditions.

Klarna Invoice Purchase

In cooperation with Klarna AB (www.klarna.de), we offer invoice payment as an option. Note that Klarna Invoice is only available to consumers, and payment must be made to Klarna. You receive the goods first and have a 14-day payment period. Full terms can be found here.

Note: We only accept payments from accounts within the European Union (EU). Any transaction fees are your responsibility.

7. Right of Withdrawal

Withdrawal Right

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period expires 14 days after the day you (or a third party designated by you) take physical possession of the goods.

To exercise your right of withdrawal, you must inform us of your decision to withdraw by sending a clear statement (e.g., via letter, fax, or email). You may use the model withdrawal form provided (not mandatory).

Upon receiving your withdrawal notice, we will send a confirmation email. The withdrawal is valid if sent before the 14-day period expires.

Effects of Withdrawal

If you withdraw, we will refund all payments received from you (including delivery costs, except for additional costs resulting from your choice of a more expensive delivery method than our standard option) within 14 days of receiving your withdrawal notice.

We may withhold the refund until we receive the returned goods or proof of shipment.

Return Shipment

You must return the goods within 14 days of notifying us of withdrawal. You bear the direct cost of return.

You are only liable for any diminished value of the goods resulting from unnecessary handling beyond checking their condition and functionality.

This withdrawal policy does not apply to:

  • Custom-made or personalized goods.

  • Sealed goods unsealed after delivery (e.g., hygiene products).

8. Voluntary Return Policy

You do not offer a voluntary return policy.

9. Delivery & Delivery Time

Deliveries are also possible abroad. Goods are only sold in household quantities and to end consumers.

10. Shipping Costs

Orders from AK Webdesign are shipped free of charge.

11. Warranty

If delivered items have obvious material or manufacturing defects (including transport damage), you must report these immediately to us or the delivery personnel. Failure to do so does not affect your statutory rights.

During the statutory warranty period, you are entitled to:

  • Repair or replacement.

  • Price reduction or contract termination (if legally applicable).

  • Damages (including wasted expenses).

The warranty period for new goods is 2 years, except for items excluded under § 312g (2) of the German Civil Code (BGB).

12. Retention of Title

The goods remain the property of AK Webdesign (Other) until full payment is received.

13. Liability

We are fully liable for intentional acts and gross negligence, as well as under the Product Liability Act.

For slight negligence, we are only liable for:

  • Injury to life, body, or health.

  • Breach of essential contractual obligations (those necessary for proper contract execution).

Liability for slight negligence is limited to foreseeable damages at the time of contract conclusion. This limitation also applies to our agents.
